Woman accused of having sex with minor arrested
Malawi Police have arrested 40-year-old woman, Mercy Kadosa of Kapalamula Village, Traditional Authority Kachere in Dedza District for allegedly indulging in sexual activity with a 12-year-old boy.
According to Kasungu Police Deputy Public Relations Officer, Harry Namwaza, the woman alleged that the boy approached the suspect for a short-time sex with her and that after leaving, people tipped off police.
“It is alleged that the boy approached the suspect at a certain bar where she was treating herself to some bottles of beer. The suspect charged the boy MK2,000 but the latter bargained to MK1,000.
“After agreeing, the suspect took the boy to her room but some people who were drinking (around the place) became suspicious of the suspect for leaving the place with the boy, considering his tender age,” said Namwaza.
The people around informed the police about the suspected sexual agreement who then rushed to Thokozani Rest House where the suspect was staying. However, at the time the police arrived, the two had already fulfilled their arranged sexual activity.
Meanwhile, the police have arrested the suspect and charged her with an offence of indulging in sexual activity with a child contrary to Section 160 (b) of the Penal Code.

If I were the said woman I wud not luz this case. A police akuMalawi tulo, phuma too much. How do they know the boy is indeed 12 yrs? Was the woman checked for penetration by a medical specialist and did she not have sex with other men before the boy? How far away is the bar from the boys home? What did the people who were drinking and later report the incident to police do prior to the boy going away with the woman (was it a trap?)?

If it were the opposite, that is a 40-yo male having sex with a 12-yo girl, defilement charges were to slapped against him! That’s about it!

the issue is about the age of the boy. the framers of the law its intention is to allow someone who is mature enough and 16yrs was thought to be the right age that one can make imformed choice. this is one way of protecting the children from abuses. the truthis that any one who is young/small child we fail to make good decisions for instance i will be difficult to use a condom due to lack of knowledge and reasoning . thats why it it illegal to allow any one below 18 yrs to drink in bottle stores
Agreement with a 12 year old?
So the Police does exist and it can arrest wrongdoers. Now go and apprehend all the looters and lock them up. Focus on bigger cases and not just these sexual offence and animal cruelty cases
ur missing the point. children needs protection as the way parents does to thier children. the state is thier to prptect them. suppose it was ur child doing that. will utolarate that? If that child gets HIV will u happy. let us protect them up to the age when they will be able to make mature and indepent decisions which are sound . for now parents and the state we should take care of them

its not allowed by law to have sex with a minor. whether u have agreed or not period. In this case the adult will be prosecuted becoz the law penelises the adult becoz it is regarded is of sound mind and should protect the child.
