‘Midnight 6 resurfaces in different form’: DPP asks Chilima to resign as Malawi VP
Vice President Dr Saulos Chilima has been asked to honour his oath of office by doing the right thing and resign from his position in order to pursue his dream without compromising the honour and dignity of that office.
The call was made in Lilongwe on Friday when Democratic Progressive party (DPP) senior officials addressed a press briefing to clarify on issues raised by the country’s Vice President last Saturday.
On 21st July, 2018 the Vice President addressed a rally at Masintha ground in the Capital City, where he launched a political grouping called United Transformation Movement (UTM).
A statement read out by DPP Publicity Secretary, Nicholas Dausi, says the activities undertaken by Chilima are a mockery of the oath of office and the Constitution he swore to defend and protect.
Dausi observed that it will be difficult for Chilima to defend the presidency as well as government policies while he is leading a grouping which is political in nature other than that which ushered him to power.
“It is clear that the movement which is being led by Dr. Saulos Chilima is espousing policies that are opposed to those championed by the current government led by Prof Arthur Peter Mutharika, of which he is technically a member,” he said.
He further said if Chilima is a true democrat which he claims to be, he should realise that he cannot practice opposition politics within the government that he is part of.
Dausi advised Chilima that his office has no independent existence of its own but rather it is intended to support that of the President saying his (Chilima) claim that he can continue to occupy office of Vice President lacks legitimacy and is laughable.
“If Dr Saulos Chilima is a believer in the rule of law and fully understands what collective cabinet responsibility entails, he cannot eat his cake and have it at the same time by remaining in the position of Vice President.
“It is, therefore, a big lie by him and betrayal of acceptable democratic tenets and values for him and those who support his cause to claim that Dr Saulos Chilima has a contract with the people of Malawi to continue serving in the office of the Vice President up to 2019,” said Dausi.
DPP Vice President for the North Goodall Gondwe said the party leaves it up to the Vice President to resign saying what the party is pointing out are inconsistencies that have been created of the government which Chilima is part of.
Gondwe appealed to the movement to desist from insults but rather concentrate on what they would do for the people of Malawi.
DPP senior member, Samuel Tembenu said Chilima cannot pretend to be part of government and at the same time oppose it. As such Tembenu said the Veep needs to step down honorably and practice his politics freely.
Chilima was nominated by Mutharika as his running mate during the 2014 Tripartite Elections a process that led him to becoming Vice President of the Republic of Malawi.
According to the Constitution of the Republic of Malawi the Veep is a member of the Cabinet which exercises the core functions of the Executive arm of Government and as such he has the constitutional responsibility of advising the president with respect to the policies of the government and such matters as may be referred to the cabinet by the president.

The Constitution of The Republic of Malawi is outdated. To avoid issues like these I have always theorized of having a Vice President who serves as prime minister by law. Our current constitution is very vague on the power and role of the Vice President the only certain thing about that office is the fact that is provides a safeguard to stop Malawi from having a power vacuum in the event the the president is incapacitated to continue ruling the country. Apart from that the Vice President role and power is largely at the discretion of the President. The constitution give power to the president to appoint a Vice President but it is flawed because the president cannot fire the Vice President, if that was provided for in the constitution we would not have this so called wrangles between the two highest offices in the republic. My proposal is to have a constitutional amendment that either allows give power to hire and fire the VP to the president to the president as some. Have suggested. If some think that it will be too much power to the president we can add a close that the nomination requires some sort of majority approval in parliament. The other option is to run Malawi as a semi presidential state where the Vice President is De facto prime minister Serving as head of government he is to be drawn from parliament and his role would be to push government agenda in parliament, he will handle all domestic issue and advice the president on ministerial appointments. The president will retain his role as head of state, chief of police and army and will be the ultimate authority in the land with constitutionally backed powers to double check all appointments and sign into effect law and policy adopted via parliamentary discussions. He would also be in charge of foreign affairs and the power to declare war and states of emergency. In my opinion the dpp could have offered chilima such a deal when they had a chance going into 2019. The terms would have been APM president, chief of armed forces, head of state and in the office of the president you have the Deputy Minister for Executive/Cabinet Affairs. SKC would have been Vice President, Head of Government and on his office you have a deputy minister for Parliamentary affairs. The minister of parliamentary affairs and the minister of cabinet affairs are both mandatory MPs the cabinet affairs guy serves to link presidential responsibilities to cabinet and the parliamentary guy serves as the man to push government policy in parliament and to monitor parliamentary trends for the executive.
No one in Malawi elected Chilima. We elected president of Malawi not vice. Even if there was a dog as running mate to Peter Peter would still have won.

The vice presidency is largely an executive office but it is also a political office because of succession to the Presidency. in the absence of the President the Vice-president becomes the highest authority and makes key decisions regarding the state and government of Malawi. He is also second in command of Cabinet which governs Malawi, meaning whatever corrupt and inefficient practices that are rampant in governance and public service of Malawi he is part and parcel of it.if he is not part of it he would and should resign not only from the party but also the government he is part of. From what I hear and read he is not against DPP he has an issue with how the government is run DPP and government are not the same thing. If he doesn’t agree with APM’s governance, then be cant be APM’s second in command, he must go, unfortunately, APM cannot fire him. You cannot serve as second in command in an organization whose policy and work you do not agree with and get paid. That is greed. What is sending out to me personally is I do not agree with government looting but hey he benefits are good for me to leave my post in the thieving government. He is not different from the people he is accusing of looting public funds, he does agree with the leadership of APM, his policies and his cabinet choices, then he must leave the office because you cannot be deputy leader of a decision-making body that you fiercely disagree with. If he gets any hostile treatment from the executive for clinging on to an office, I won’t be surprised, the only way one can legally become president without an election is by moving from vice president to president and that is where the issue is. No one knows what is motive is by fiercely criticising the government and the president yet clinging on to the office of vice president his only guaranteed hurdle free route to the office of the presidency without an election. I don’t buy the argument that he is there to expose the rottenness of government, you can do that from the outside, in fact it is better to do son from outside to prove his innocence, from all we know the vice presidency could have some dirt on its doorstep too and the only reason he is not living until the next election is to protection himself too.

If Chilima resigns, APM will constitutionally have the powers to appoint another VP. That what any other president would do in the event of his or her VP death, resignation or incapacitation.
