Malawi election appeal ruling Friday May 8
Seven judges of the Malawi Supreme Court of Appeal will this Friday May 8 deliver their determination on an appeal against a Constitutional Court judgement that overturned the May 21 2019 presidential election and called for fresh presidential polls which are slated for July 2 2020.
The panel comprising Chief Justice Andrew Nyirenda, JAs Edward Twea, Anaclet Chipeta, Anthony Kamanga, Frank Kapanda, Lovemore Chikopa and Rezine Mzikamanda will deliver the ruling with restrictions in compliance w i t h coronavirus (Covid-19) preventive measures.
In its communication, Malawi Supreme Court of Appeal registrar Agnes Patemba said both petitioners and respondents will be represented by a maximum of two lawyers each. This will reduce the number of lawyers for the parties in the case from about 20 in the Constitutional Court to eight.
Besides the lawyers, the court will also allow at least three people from each party as well as impose restrictions on media coverage
In the case, MEC and President Peter Mutharika of Democratic Progressive Party challenged the February 3 2020 judgement of the five-judge panel of the High Court of Malawi sitting as the Constitutional Court which nullified the presidential election, citing irregularities in the results management system.
The lower court also ordered a fresh presidential election within 150 days of its judgement.
The country’s estranged Vice-President Saulos Chilima—who contested the May 21 presidential race on a UTM Party ticket— and Malawi Congress Party (MCP) president Lazarus Chakwera had challenged the presidential election results and the Constitutional Court granted them their wish.

I join those who can PRAY earnestly to our Sovereign God that Justice and Righteousness should prevail over the ruling of this case. Our God is alive, and is Not a respecter of a person. As we humbly come to Him and ask for His rightful intervention He will surely hear our cry. This is case like that of Ester and Mordechai versus Harman. I call upon the upon the faithful to wake up in the Middle of the Night to cry to our God for Justice to prevail. God have mercy.

Cadet Bauleni your school did not help you. Malawi is a sovereign state this means it has its constitution that governs the country. You should know that these are for Malawi not Muthalika. He is there to uphold this constitution because it is not Muthalika laws but Malawi laws therefore generations upon generations will be governed by these laws. The courts are there to determine and correct according to law. Courts ruling becomes law and needs to be adhered to. It shows here u never went to school yourself and if you did.. it didn’t help you at all. 3 separate arms of government with sepepation of powers as the main pillar to democracy. No branch can/should impose on the other. The judges can’t force the president, the same way president can’t force the judges on individual court cases.

Whichever way the ruling goes Malawi will never ever be the same again. I am sure sane politicians as well as insane politicians have learned one crucial lesson and that is : NO SANE POLITICIAN WILL EVER TAKE MALAWIANS FOR GRANTED EVER AGAIN! Thank YOU JESUS!
Don’t forget the clause of tripartite elections we need an overhaul of the whole electoral process not only cha president. The same ref can’t do better on the other half and bad the other half . Tivote zonse basi.
Election losers should never ever be allowed to form a government. This is creating unlimited presidential terms. It needs to stop now. Why bother having elections when one can rule for unlimited terms or for life?
